GlastoNav Terms & Conditions


This legal agreement applies to the entire contents of the GlastoNav mobile phone application and all other Orange UK associated services.

The Service (“Service”) consisting of a Java mobile phone application is provided by Icom Limited “SUPPLIER”, for and on behalf of ORANGE PERSONAL COMMUNICATIONS SERVICES LIMITED herein referred to jointly as “we”, “us” “our”.

In order to use the Service you, the user (“user”, “you”), must first accept our Terms and Conditions (“Terms and Conditions”) and Privacy Policy (“Privacy Policy”). If you do not accept our Terms and Conditions and Privacy Policy you are not permitted to use the Service.

By downloading and using the Service you are deemed to have accepted these Terms and Conditions and Privacy Policy and are therefore entering into a legally binding agreement with ORANGE PERSONAL COMMUNICATIONS SERVICES LIMITED of St James Court, Great Park Road, Almondsbury Park, Bradley Stoke, Bristol BS32 4QJ.


To Begin With:
In order to provide you with the Service and to maintain future provision of the Service we need to collect and use some information relating to your Mobile Telephone. We use your MSISDN, which in simple terms is your Mobile Telephone Number, and when you connect to our provisioning servers we check your make model and network of your handset to ensure that we send you the correct version of the Service to download.

We are always looking for new ways to make our services more useful to our users, this means we may need to change the way the Service works, looks or functions. We, therefore, reserve the right to change the Terms and Conditions or the Privacy Policy at our discretion to reflect any changes to the Service.

PLEASE NOTE: You will be bound by the version of the Terms and Conditions and Privacy Policy that are posted on this website when you use the Service. We therefore recommend that you check back from time to time to see if anything is new or different.

Downloading the Service:
Each download of the Service is for one individual user only, this is very important for both your security and the correct working of the Service. The Service requires that all information is related to a single person so that the personalised elements of the Service remain accurate and relevant. By downloading the Service you warrant that you are doing so for your personal use only. You further warrant that you have not been revoked, removed, banned or suspended from the use of the Service at any time for any reason whatsoever, whether or not under a different identity.

The responsibility for the security of information within your phone is down to you, so remember always keep you phone safe and PIN locked!

At Orange we generally do not like to interfere but some things do warrant intervention so, to avoid such measures, we suggest you employ your best judgment at all times when using the Service.

Your Mobile Phone Number
Other than for purposes required in the provision and maintenance of the service Orange and its trusted partner the Guardian and the Observer newspapers may use your Mobile Telephone number to send you information on products or services that they think may be of interest to you. Unsubscribe details will be included in all communications.

Personally Identifiable Information
Information that you impart to the Service that could potentially identify you as an individual is kept to an absolute minimum and we do not require registration of personal details to get the Service any information that is collected is protected in every way possible.

PLEASE NOTE: SUPPLIER is a Company registered in England and Wales and as such any information or data (including Personal Information) stored by the Service will be stored in England.

Access to your Personal Information
You have the right to request a copy of the Personal Information that SUPPLIER holds about you and to have any inaccuracies corrected. (We charge £5 for information requests.) Please address requests to the Data Protection Officer at info@icomgroup.net

Interaction Tools
There are aspects of the Service that allows you to interact with other users of the Service i.e. leave messages or discuss topics publicly and, partaking in such “Public Activities” is done so at your own risk and although we take every precaution to avoid you inadvertently disclosing Personally Identifiable Information, ultimately the security of any such information when partaking in a Public Activity is down to you, the user and you agree not to hold ORANGE or SUPPLIER liable from any claim arising from your use of these Interaction Tools.

General Use of the Service
When using the Service, you are solely responsible for your conduct and actions, further you are solely responsible for any information, data, images, graphics, files, videos, clips, links and any other form of content that you submit, upload, place or cause to interact in any way with the Service.

Under no circumstances are you allowed to (without limitation) submit, upload, place or cause to interact in any way with/to the Service any information, data, images, graphics, files, videos, clips, links and any other form of content which could be deemed to be offensive, violent, threatening, malicious, damaging, defamatory, indecent, illegal, immoral, discriminatory, prejudice, homophobic, racist, plagiaristic or, infringing of a third party’s legal or equitable rights or, any analogous behavior in any territory whatsoever (“Unsuitable Material”).

We reserve the right to investigate and take any appropriate action against any user who We suspect is partaking in “Inappropriate Activities” which includes, without limitation, criminal acts or tortuous activity, including fraud, trafficking of drugs and/or people; publication of obscene material, gambling, harassment, phishing, stalking, spamming, spimming, or the uploading, transmission or transfer of harmful computer programmes, files, viruses and/or worms.
We place massive importance on the integrity of our products, services and operation and we will co-operate with any law enforcement authorities or court order requesting the company to disclose the identity or locate anyone posting any Unsuitable Material or engaging in Inappropriate Activities.

Users must appreciate and accept that although we take every precaution to avoid subjecting users to any Unsuitable Material, we cannot, and will not, be held responsible for material uploaded or transmitted into the Service by other users.

Linking
We provide the Service for individual personal use only. You may link to the Service provided:
You do not purport or imply that ORANGE or the SUPPLIER endorses any products, services, organisations or persons other than its own.

You do not present any false or misleading information relating to ORANGE or SUPPLIER in any way whatsoever.

You do not link to the Service from a website that contains any Unsuitable Material or provide a link from the Service to any other websites which contain Unsuitable Material.
If you do link to or from the Service you agree to indemnify ORANGE and SUPPLIER for any loss or damage suffered by ORANGE or SUPPLIER or any of its group of companies, agents, partners, shareholders, directors, employees or content suppliers for any breach of the provisions in relation to linking to the Service.

Ultimately, We reserves the right to revoke any express or implied right to link, and remove any link to or from the Service for any reason whatsoever, without notice.

Non-Alteration
If you provide a link to the Service for the purpose of easier navigation, as a favourite site or, any other reason relating to genuine personal use, then you do so subject to the following conditions:
You do not attempt to re-represent the Service or any aspect of the Services size, appearance, colours, text, format, structure, architecture or content of the Service or any element of the Service for any reason whatsoever.

Subsequent Terms and Conditions
As the Service grows so to will the need for more specific Terms and Conditions. These Subsequent Terms and Conditions will be indicated on the relevant interfaces and web pages as you encounter them and form part of these Terms and Conditions.

Any refusal to accept or comply with any Subsequent or additional Terms and Conditions will result in a material breach and entitle Us to terminate your use of the Service.

Disclaimer
While We endeavor to provide the most accurate and up to date service to our users, we do not warrant the accuracy, completeness or relevance of the Service or related services and subsequently disclaim any and all responsibility or liability for (without limitation) accuracy, completeness, relevance, legality, operability, availability, integrity, quality of information, content, reliability or material accessed through or displayed on the Service or related services.

Information, content or material added to, accessed through or displayed on the Service is done so on an “as is” basis without any expressed or implied warranties or guarantees of any kind whatsoever.
By using the Service, you agree to indemnify ORANGE and the SUPPLIER from any liability arising out of deletion, corruption, failure to store or mis-delivery of any information or material by ORANGE or the SUPPLIER in any aspect of the Service.

The Service and all materials, information, content products and services included or utilised in the provision of the Service is provided “as is” with no warranties whatsoever.

ORANGE and the SUPPLIER disclaim, to the fullest extent permitted by law all express, implied and Statutory Warranties including, without limitation, warranties relating to fitness for purpose, satisfactory quality and reasonable care and, skill which but for the provisions of the legal Terms and Conditions might have had effect in relation to the Service or any Products, Goods or Services of ORANGE and the SUPPLIER, whether accessed through the Service or function of the Service or other method of access howsoever.

By using the Service, you understand and agree that you use the Service at your own discretion and risk and, that you will be solely responsible for any damages to your computer, network, hardware or stored data of any form that results from your use of the Service.

Limitation of Liability
ORANGE and the SUPPLIER’s respective groups of companies, licensors, agents, partners, shareholders, directors, employees or content suppliers exclude liability and responsibility for any claim relating to this legal agreement or the subject matter hereof that may result from any user’s use or misuse of or reliance on the Service or any related services, such limitation of liability shall apply, without limitation, to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence and misrepresentation), or otherwise (even if ORANGE or the SUPPLIER is made aware of the possibility of such damages). ORANGE and the SUPPLIER’s liability will, at all times, be limited to the amount paid, if any, by you to ORANGE or the SUPPLIER for the Service during the term of registration as a user.

Termination
We may terminate this agreement, or terminate or suspend your access to the Service at any time, with or without notice. Upon such termination or suspension, your right to use the Service or related services will immediately cease. Upon termination, any information you have stored or imparted to the Service will no longer be accessible. We may keep all or some of your information for the purpose of proving and providing means of auditing and, as a historical record, but will not be used for any new purpose or communication.

Jurisdiction
Any claims arising out of use of the Service or related services will be governed under the Law of England and Wales.

Other
By accessing and using the Service you are deemed to have accept the terms of this Agreement this is further affirmed by your ongoing use of the Service.

This Agreement constitutes the entire agreement between you and Us regarding the use of the Service and, related services. Any failure or delay by Us to enforce any provision of this Agreement will not operate as a waiver of such provision.

The titles of each section are for reference purpose only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this agreement is deemed unfair, unenforceable or void, that provision shall be deemed severable and the remainder of this agreement will remain fully enforceable.

GlastonNav costs
Orange GlastoNav is free but will cost around 50p in browsing costs to download depending on your tariff.

You will be charged for the initial text message (glasto to 64446) at your standard text rates. For Orange customers this is a zero rated text message so you will not be charged.

Once downloaded to your phone, you can use Orange GlastoNav without incurring any costs. You will only incur data charges* when you use certain functionality including:

  • Sharing schedule
  • Sharing location
  • Share GlastoNav
